Privacy Policy

How we collect, use, and protect your data when you use the NE App and our services.

At Nolimits Evolution, we are committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our mobile application and services.

Features may change. We may add, modify, or discontinue app features from time to time. This policy describes our current data practices. When we change how we collect or use data in a material way, we will update this policy and the "Last Updated" date.

1. Information We Collect

We collect information in connection with the features you use. The sections below describe data we may collect when those features are available and in use.

1.1 Personal Information

We collect information that you provide directly to us, including:

  • Account information: email address, username, display name, profile photo
  • Payment information: billing address, shipping address, payment method details (processed securely through Stripe)
  • Contact information: name, email, phone number (for order fulfillment)

1.2 Location Data

When location-based features are available and you grant permission, we may collect location data to:

  • Track your running routes and distance
  • Provide location-based weather information

Location data is stored securely and only used for these purposes. You can disable location services at any time through your device settings.

1.3 Health and Fitness Data

When fitness and health-related features are available, we may access health and fitness information with your explicit permission (e.g. device motion sensors such as Core Motion on iOS) for purposes such as:

  • Step Count: We use your device's built-in motion sensors (Core Motion on iOS) to count your daily steps and display them in the app. Step count data (daily steps, weekly steps, and step goals) is synced to our servers to enable cross-device access and backup of your step tracking data.
  • User-Created Run Data: Distance, time, pace, route coordinates that you create by using the app. This data is stored on our servers to enable access across devices and maintain your workout history.
  • Weekly Goals and Statistics: Fitness statistics calculated from your runs and activities
  • Challenge Participation: Your participation and progress in fitness challenges
  • Heart Rate: Heart rate tracking is not currently available in the app.

Important: Step counting uses motion sensors on your device. Step count data is synced to our secure servers for cross-device access and backup purposes. All fitness data is stored securely and encrypted. We do not collect health data or sensitive medical information beyond fitness tracking data. You can revoke motion sensor permissions at any time through iOS Settings > Privacy & Security > Motion & Fitness.

1.4 Social Data

When you use social features (when available), we may collect:

  • Posts, comments, reactions, and likes
  • Hashtags and other metadata attached to posts
  • Chat and group messages, including replies and quoted messages where supported
  • Challenge participation and leaderboard data
  • Block lists and safety-related preferences (e.g., blocked users)

Chat storage: Messages are stored so you and participants can read conversation history. Where our platform uses encryption for chat, message content is protected in storage; operational metadata (such as timestamps, chat membership, and delivery status) may still be processed as needed to run the service.

1.5 Nutrition Data

When nutrition-related features are available and you use them, we may collect:

  • Food lookup searches and barcode scans
  • Recipe preferences and saved recipes
  • Nutritional information you view or save

Food and nutrition lookups may be processed through our servers and, where configured, the Edamam food database API to return nutritional data. Queries are subject to Edamam's terms and privacy policy.

1.6 Usage Data and Product Analytics

We automatically collect certain information when you use our app, such as:

  • Device information: device type, operating system, and related technical identifiers as needed for the service
  • App usage: features used, screens or flows, and in-app interactions
  • Data related to in-app features you use (e.g. preferences or history within those features)

When you are signed in, we may also log activity events to our own backend (for example feature usage, fitness or social actions, and session context) together with a session identifier and limited device metadata. We use this to operate, secure, and improve the app—not to sell your personal information and not for third-party advertising.

1.7 NE Smart Data (On-Device Machine Learning)

When the NE Smart feature is available, it is an on-device machine learning system that can provide personalized insights, predictions, and recommendations. When enabled, NE Smart processes data primarily on your device and may collect and analyze:

  • Run patterns: time of day, day of week, weather conditions, performance metrics
  • Step patterns: daily step counts, weekly patterns, goal achievement trends
  • Pace trends and performance improvements over time
  • Training patterns and recovery needs
  • Goal achievement patterns and predictions
  • Optimal running conditions based on historical data

Data Storage and Sync: To enable cross-device access to your personalized insights, NE Smart learning data (run patterns, derived step patterns and trends, predictions, and insights) is synced to our secure database and associated with your user account. Note: We do not sync your actual step counts or raw step data - only derived patterns and insights for personalization. This allows you to access your personalized recommendations when you switch devices or reinstall the app. All data is encrypted and stored securely with row-level security policies ensuring only you can access your own learning data.

Privacy and Control: Your NE Smart learning data is private and only accessible to you. This data is used solely to provide personalized insights and recommendations. No machine learning data is shared with third parties or used for advertising purposes. You can disable NE Smart at any time through app settings, which will stop data collection and analysis. You can also delete your NE Smart learning data at any time, which will remove it from both your device and our servers. Disabling NE Smart will not affect other app features.

1.8 Phonecap and Mephonecast (multi-device capture)

If you use Phonecap inside the Nolimits Evolution app together with the separate Mephonecast desktop application, additional data flows apply:

  • Camera and microphone: Video and audio capture use your device's camera and microphone when you start recording. Media is recorded on the phone unless you use features that upload or sync to cloud projects where offered.
  • Local network: The phone and desktop communicate over your Wi‑Fi / local network (for example WebSocket signaling and, where supported, WebRTC for live preview). Connection details, device names, and session identifiers may be exchanged to pair devices and control recording.
  • Recordings on device: Files typically stay on the phone until you pull or sync them using Mephonecast or related flows described in the app.
  • Optional cloud: If you use optional subscriber cloud projects, previews or files may be processed or stored according to that feature's settings and our agreements with infrastructure providers.

The Mephonecast desktop app is a separate install; its use is also subject to any terms or notices presented with that software. This Privacy Policy primarily describes the mobile app and our online services.

2. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve our services
  • Process transactions and send order confirmations
  • Track and display your fitness progress and statistics
  • Enable social features like challenges, posts, messaging, and reactions
  • Operate Phonecap / Mephonecast pairing, recording control, and related capture features
  • Send you notifications about achievements, challenges, and updates
  • Provide personalized content and recommendations
  • Enable NE Smart features for on-device analytics and predictions
  • Respond to your inquiries and provide customer support
  • Detect, prevent, and address technical issues and security threats
  • Comply with legal obligations

3. Data Storage and Security

Your data is stored securely using Supabase, which provides:

  • Encryption at rest and in transit
  • Row-level security policies to ensure data privacy
  • Regular security audits and compliance certifications

Payment information is processed securely through Stripe and is not stored on our servers. We use industry-standard security measures to protect your personal information, but no method of transmission over the internet or electronic storage is 100% secure.

4. Data Sharing and Disclosure

We do not sell your personal information. We may share your information only in the following circumstances:

  • Service Providers: We share data with third-party service providers who perform services on our behalf (e.g., Stripe for payments, weather APIs, nutrition APIs such as Edamam, and infrastructure for push notifications)
  • Motion Sensors: We use your device's motion sensors (Core Motion on iOS) to track steps. Step count data is synced to our servers for cross-device access and is not shared with third parties.
  • Public Content: Posts, comments, and challenge participation may be visible to other users as part of the app's social features
  • Legal Requirements: We may disclose information if required by law or to protect our rights and safety
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred

5. Your Rights and Choices

You have the following rights regarding your personal information:

  • Access: You can access and review your personal data through the app settings
  • Correction: You can update your profile information at any time
  • Deletion: You can delete your account and all associated data directly from the app by going to Settings > Data & Account > Delete Account. Account deletion is permanent and cannot be undone. Alternatively, you can request account deletion by contacting us
  • Location: You can disable location services through your device settings
  • Notifications: You can manage notification preferences in app settings
  • Data Export: You can request a copy of your data in a portable format

6. Children's Privacy

Our app is not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe we have collected information from a child under 13, please contact us immediately.

7. Third-Party Services

Depending on which features are available, our app may integrate with third-party services such as:

  • Stripe: Payment processing (see Stripe's privacy policy)
  • Supabase: Database and authentication services
  • OpenWeather (or similar): Weather information when that feature is enabled
  • Edamam: Food and nutrition database lookups (via our API)
  • USDA Food Data: Additional nutrition information where used
  • Push notifications: Apple Push Notification service (APNs) on iOS and Firebase Cloud Messaging (FCM) on Android when configured, via Expo or equivalent push pipelines
  • Content safety: In some cases, text may be analyzed by automated or third-party moderation tools to block abuse; providers are subject to their own policies
  • Core Motion (iOS): Motion sensors for step counting. Step count data is synced to our servers for cross-device access. Step counting is optional and can be disabled at any time.

These services have their own privacy policies, and we encourage you to review them.

8. Data Retention

We retain your personal information for as long as necessary to provide our services and fulfill the purposes outlined in this policy. When you delete your account (either through the app or by contacting us), we will permanently delete your account and personal information immediately, except where we are required to retain it for legal or business purposes (e.g., tax records, dispute resolution, aggregated anonymized statistics).

9. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence. These countries may have data protection laws that differ from those in your country. We ensure appropriate safeguards are in place to protect your information.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the new Privacy Policy in the app and updating the "Last Updated" date. Your continued use of the app after such changes constitutes acceptance of the updated policy.
